Types of Work Visas
Specialty Occupations – H-1B Visa
Under U.S. immigration law, a specialty occupation refers to a position that requires theoretical and practical application of a body of highly specialized knowledge and at least a bachelor’s degree or its equivalent. This is primarily governed by the Immigration and Nationality Act (INA) §101(a)(15)(H)(i)(b) and detailed under 8 CFR §214.2(h). Examples include fields like IT, engineering, mathematics, and healthcare. Employers must demonstrate the role meets these criteria and file a Labor Condition Application (LCA) with the Department of Labor before petitioning for the H-1B visa on behalf of the foreign worker.
H-1B1 Visa for Nationals of Chile and Singapore
The H-1B1 visa is a U.S. work visa specifically available to nationals of Chile and Singapore under free trade agreements. It is similar to the H-1B visa and applies to specialty occupations requiring at least a bachelor’s degree. Governed by INA §101(a)(15)(H)(i)(b1) and 8 CFR §214.2(h)(9)(i)(B), this category offers 1,400 visas for Chile and 5,400 for Singapore annually. Unlike the regular H-1B, H-1B1 applicants may apply directly at a U.S. Embassy without prior USCIS petition approval. The visa is valid for one year but can be renewed indefinitely.
H-2A Visa – Temporary Agricultural Workers
The H-2A visa allows U.S. employers to bring foreign nationals to the U.S. for temporary or seasonal agricultural work. It is governed by INA §101(a)(15)(H)(ii)(a) and 8 CFR §214.2(h)(5). To qualify, the employer must prove there are not enough U.S. workers who are able, willing, and qualified to do the work, and that employing foreign workers won’t negatively impact U.S. workers' wages or conditions. A temporary labor certification from the Department of Labor is required before filing the petition with USCIS. Common jobs include harvesting, planting, and livestock care.
