What Makes a DUI a Felony in Florida
Florida Statute § 316.193 defines the circumstances that elevate a DUI from a misdemeanor to a felony. Which category applies to your charge matters, because each carries different mandatory minimums and sentencing ranges.

- DUI manslaughter: A second-degree felony carrying up to 15 years in state prison and a mandatory minimum of 4 years. It escalates to a first-degree felony carrying up to 30 years if the driver knew of the crash and failed to render aid, or if a prior DUI manslaughter conviction exists.
