How Florida Law Defines Robbery
Under Florida Statute 812.13(1), robbery is the taking of money or property from another person with the intent to permanently or temporarily deprive them of it, when force, violence, assault, or putting the victim in fear occurs during or in the course of the taking. That element is what separates robbery from theft.
Even minimal force can be enough. A prosecutor doesn’t need to prove the victim physically resisted. Placing a person in reasonable fear of harm meets the statutory definition, and that distinction matters enormously for how a case is charged and how it should be defended.
Types of Robbery Charges in Florida
Florida law defines several distinct robbery offenses, each carrying its own felony classification:
- Strong-arm robbery (Florida Statute 812.13(2)(c)): Taking property using physical force or threat of force without a weapon. Second-degree felony.
- Robbery with a firearm or deadly weapon (Florida Statute 812.13(2)(a)): Carrying a firearm or weapon during the robbery, even if not used. First-degree felony.
- Robbery by sudden snatching (Florida Statute 812.131): Taking property directly from a person who becomes aware of the taking. Third-degree felony.
- Home invasion robbery (Florida Statute 812.135): Entering a dwelling and robbing the occupants while present. First-degree felony.
- Carjacking (Florida Statute 812.133): Forcibly taking a vehicle using force, violence, or threats. First-degree felony.
Penalties for a Robbery Conviction in Florida
Sentencing exposure for a robbery conviction depends on how the charge is classified:
- Third-degree felony (robbery by sudden snatching): Up to 5 years in prison and up to $5,000 in fines.
- Second-degree felony (strong-arm robbery): Up to 15 years in prison, up to 15 years of probation, and up to $10,000 in fines.
- First-degree felony (armed robbery, home invasion robbery, carjacking): Up to 30 years in prison and up to $10,000 in fines.
Florida’s 10-20-Life law (Florida Statute 775.087) adds mandatory minimum sentences when a firearm is involved. Displaying a firearm during a robbery triggers a 10-year minimum. Discharging it triggers 20 years. If the discharge causes death or great bodily harm, the minimum rises to 25 years. These minimums are generally not subject to judicial discretion.
